Terms of Service & Acceptable Use Policy

You must be of legal age to form a binding contract in your jurisdiction and legally capable of using the Service.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at support@kwklink.com if you suspect unauthorized access or any security incident involving your account.

You may not use kwklink, in whole or in part, directly or indirectly, for any of the following:

• Spam or unsolicited bulk messaging
• Phishing or credential harvesting
• Distributing malware, viruses, ransomware, malicious scripts, or other harmful code
• Impersonation of any person, organization, or brand
• Deceptive redirects, cloaking, or destination masking
• Trademark or copyright infringement
• Abuse of APIs, automation, scraping, or bots, including unauthorized programmatic access
• Bypassing moderation, rate limits, quotas, or other platform restrictions
• Unlawful content or activity under any applicable law
• Harassment, threats, abuse, or hate speech
• Violations of TCPA, CAN-SPAM, GDPR, CASL, or similar communication and privacy laws

You are solely responsible for the destination URLs you shorten, the content you host on workspace hubs and digital business cards, and any communications you send using kwklink links.

You retain ownership of the content you submit. You grant kwklink a worldwide, non-exclusive, royalty-free, limited license to host, store, process, display, cache, transmit, and distribute that content solely as necessary to operate, secure, and improve the Service.

kwklink may, in its sole discretion and without prior notice, take any action it considers appropriate to protect users, recipients, and the platform, including:

• Suspending or disabling accounts
• Removing links, pages, hubs, cards, or other content
• Blocking destination URLs or domains
• Investigating suspected abuse, fraud, or security incidents
• Cooperating with law enforcement and regulators where legally required
• Terminating repeat offenders and accounts that pose ongoing risk

The kwklink name, logos, branding, software, designs, user interfaces, and underlying functionality are owned by kwklink and protected by intellectual property laws. You may not copy, modify, reverse engineer, or create derivative works from any part of the Service except as expressly permitted.

Infringement of third-party intellectual property is prohibited. A dedicated DMCA / Copyright Policy with takedown procedures will be published separately and incorporated into these terms by reference.

Paid plans are billed on a recurring basis (monthly or annual) at the rates listed at checkout. By subscribing, you authorize kwklink to charge your payment method on each renewal until you cancel.

If a payment fails or remains unpaid, kwklink may suspend or downgrade your account until the balance is resolved. Pricing, plan features, and limits may change with reasonable notice. Payments are non-refundable except where refunds are required by applicable law.

The Service is provided on an “as is” and “as available” basis. Features may be added, changed, interrupted, degraded, or discontinued at any time. We do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by law, kwklink disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, and uninterrupted or secure operation. Your use of the Service is at your own risk.

To the maximum extent permitted by law, kwklink and its operators, employees, contractors, affiliates, and partners will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Service.

kwklink is not liable for outages, downtime, data loss, business interruption, lost revenue, or for content or actions of third parties. Our aggregate liability for any claim arising out of or related to these terms or the Service is capped at the total fees you paid to kwklink in the twelve (12) months immediately preceding the event giving rise to the claim.

You will defend, indemnify, and hold harmless kwklink and its operators, employees, contractors, affiliates, and partners from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your content, your use of the Service, or your violation of these terms or applicable law.

You may stop using the Service at any time. kwklink may suspend or terminate your access, in whole or in part, for any violation of these terms or where your continued access poses a risk to users, recipients, or the platform. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

These terms are governed by the laws of the State of Iowa, without regard to its conflict of laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Iowa for any dispute arising out of or related to these terms or the Service.

We may update these terms as the product evolves. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, by additional notice. Your continued use of the Service after changes are posted constitutes acceptance of the updated terms.

Your use of the Service is also governed by our Privacy Policy, which will be published separately and incorporated into these terms by reference. The Privacy Policy describes how we collect, use, and safeguard information in connection with the Service.
